    Nóta A variety of statutes govern judicial intervention. The Family Law (Scotland) Act 1985 abolished historic alimentary obligations, such as obligation of grandparents to aliment grandchildren. In England, Children and Young Persons Act 1933 Section 1(1) provides that a parent or other person legally liable to maintain a child or young person, or the legal guardian of a child or young person, shall be deemed to have neglected him in a manner likely to cause injury to his health if he has failed to provide adequate food, clothing, medical aid or lodging for him. Note also Article 27 of UN Convention on Rights of Child. UK did not take part in adoption of Regulation 4/2009 but has since applied to opt-in.

    Nóta L'obligation alimentaire peut être satisfaite en espèces ou en nature (hébergement, etc.). - Obligation entre époux: l'obligation alimentaire résulte du devoir de secours pendant le mariage. Après rupture de la communauté de vie, elle se transforme en pension alimentaire que le juge peut condamner l'un des époux à verser à l'autre.- Obligation envers les ascendants: les enfants sont soumis à une obligation alimentaire envers leurs ascendants (parents et grands-parents). Si ces derniers sont dans le besoin, ils peuvent demander une pension alimentaire aux enfants. (b) d’un enfant mineur: il s'agit d'une «obligation d’entretien» qui concerne non seulement les aliments (nourriture, logement, habillement, etc.) mais aussi l’éducation (frais d’études, etc.). En principe, cette obligation d’entretien cesse à la majorité de l’enfant.
