    Comment L’opposition au mariage est un acte juridique contenant défense à l’officier d’état civil de procéder à la célébration du mariage jusqu’à ce que la mainlevée en ait été obtenue, soit par renonciation de l’opposant, soit par décision du tribunal. L’opposition est un acte juridique à distinguer de l’avis officieux, qui n’en est pas un; ce dernier constitue un simple avertissement. L’opposition est soumise à des conditions de forme strictes et doit se faire par acte d’huissier contenant certaines mentions particulières (art. 176 code civil), tandis que l’avis officieux peut prendre une forme quelconque, écrite ou orale. Seules certaines personnes peuvent utiliser la voie légale de l’opposition, alors que l’avis officieux peut être adressé par toute personne à l’officier d’état civil. Enfin, l’opposition oblige l’officier d’état civil à surseoir à la célébration du mariage jusqu’au jugement (art. 177 et 178 code civil) ou pendant une année révolue, alors que l’avis officieux n’a aucun effet obligation vis-à-vis de l’officier d’état civil, du moins en théorie (en pratique, il sera rarement laissé sans effet et on cherchera au moins à procéder à des vérifications). L’opposition n’est aujourd’hui plus pratiquée qu’à titre exceptionnel et conduit le plus souvent à une mainlevée judiciaire. Mais la matière connaît un regain d’intérêt avec la lutte contre les mariages fictifs. Les titulaires du droit d’opposition sont le conjoint, les père et mère ou, à défaut, les aïeuls ou, à défaut d’aucun ascendant, le frère ou la sœur, l’oncle ou la tante, le cousin ou la cousine germains, majeurs, le tuteur ou le curateur mais dans des cas déterminés (art. 172 et suiv. code civil). Le législateur, soucieux de lutter contre les mariages fictifs, a consacré le droit à opposition du ministère public (art. 175-1 code civil) dans les hypothèses où il pourrait demander la nullité du mariage. Enfin, l’art. 175-2 code civil ouvre le droit de faire opposition au procureur de la République lorsqu’il existe des indices sérieux laissant présumer que le mariage envisagé est susceptible d’être annulé pour défaut ou vice du consentement.
