Nóta "The only autonomous legal (quite narrow) definition of the notion of worker is found in the Occupational Safety and Health (OSH) Framework Directive 89/391/EEC (sse entry 109901). The definition of worker from the Commission proposal for a Working Conditions Directive [adopted as Directive (EU) 2019/1152] was not retained in the final text.Nevertheless, the concept of worker, in the context of protection offered by EU labour law, is more complex and has been shaped for decades by numerous decisions of the Court of Justice of the European Union (formerly the European Court of Justice). The main lines around which the understanding of this concept is articulated are: it has a specific meaning in EU law and cannot be subject to national definitions or be interpreted restrictively, and it covers any person who undertakes genuine and effective work for which they are paid under the direction of someone else1. The Court’s case law extended the meaning of worker beyond employee in order to cover other people engaged in economic activity, even without a contract of employment, and even including those without a contract at all but who are seeking work2."
