    Nóta L'évolution de la jurisprudence fait ressortir le principe suivant : les parents sont responsables du simple fait causal du mineur même si ce fait ne constitue pas une faute. Il s’agit d’une responsabilité de plein droit qui résulte du risque qui a été créé. En principe, les parents sont présumés solidairement responsables des fautes et dommages commis par leurs enfants mineurs à condition que: 1)les parents exercent l'autorité parentale. En cas de séparation, le parent qui n’exerce pas l’autorité parentale ne peut pas voir sa responsabilité engagée; 2) l’enfant habite avec ses parents. Les parents ne sont pas présumés responsables quand l’enfant ne vit pas sous le même toit qu’eux pour une raison “légitime” (internat, vacances).
