    Nóta Rechtsvergleichende Anmerkung: . Im französischen Recht sind die Straftaten (IATE:3584001 ) in drei Kategorien gegliedert: contravention, délit ( IATE:3584109 ) und crime (IATE:3584104 ). Die "contravention" ist die schwächste Straftat. Sie wird ihrerseits in fünf Klassen untergliedert, die von der Beleidigung bis zu vergleichsweise leichten Straftaten gegen die körperliche Unversehrtheit reichen. Je nach Schwere des Vorwurfs ist entweder der "juge de proximité" oder das "tribunal de police" für die Entscheidung zuständig. Gemäß Artikel 131-12 des französischen Code pénal ( https://www.legifrance.gouv.fr/affichCode.do;jsessionid=CED7529C420BD52DF25B08CC55A8CF37.tpdila22v_3?idSectionTA=LEGISCTA000006181730&cidTexte=LEGITEXT000006070719&dateTexte=20111102 ) ist die "contravention" mit Geldstrafe oder verschiedenen anderen Strafen wie etwa einem Fahrverbot bedroht, aber in keinem Fall mit Freiheitsstrafe. . In Deutschland und Österreich gibt es keinen der französischen "contravention" entsprechenden Rechtsbegriff. Nach § 12 StGB (in Deutschland) beziehungsweise § 17 StGB (in Österreich) werden Straftaten nach der Schwere der angedrohten Strafe in lediglich zwei Kategorien, nämlich Verbrechen ( IATE:3585133 ) und Vergehen ( IATE:3584971 ) eingeordnet. Beide Deliktstypen können im Gegensatz zur "contravention" mit Freiheitsstrafe bedroht sein. . Ordnungswidrigkeiten (IATE:3584095 ) sind Gesetzesverstöße "ohne kriminellen Gehalt". Sie wiegen weniger schwer als eine Straftat und werden deshalb nur mit einer Geldbuße geahndet, nicht mit einer Strafe. Rechtssystematisch gehören sie nicht zum Strafrecht, sondern zum Verwaltungsrecht. In Österreich spricht man von " Verwaltungsübertretung"; insoweit lebt also der Begriff "Übertretung" fort. Im französischen Recht entspricht die Ordnungswidrigkeit bzw. Verwaltungsübertretung der "infraction administrative" ("Verwaltungsstraftat"). Die "contravention" kann damit nicht gleichgesetzt werden. . Wenn man den Begriff nicht unübersetzt lassen möchte, kommen verschiedene Lösungen in Betracht. Zum einen kann man (wie etwa in der deutschen Fassung des belgischen Strafgesetzbuchs) mit dem Begriff "Übertretung" arbeiten, der zwar mittlerweile obsolet ist, aber früher weitgehend der "contravention" entsprach. Zum anderen kann man von einem "Vergehen" sprechen, da dies nach aktuellem deutschem Recht schließlich die unterste Kategorie darstellt. Um eine Festlegung zu vermeiden, kommt schließlich auch eine Umschreibung wie "geringfügige Straftat" in Betracht.
