Les fournisseurs de services sont soumis aux lois de leur pays d'origine, et non à celles du pays dans lequel ils fournissent un service. La directive couvre une large gamme de services, des agences de voyage aux services de santé. Les services faisant déjà l'objet de dispositions spécifiques du droit communautaire (services financiers, télécommunications, transports.,...) sont exclus du champ d'application de la directive.
