- Comment Die F&E-Dienstleistungen können z.B. Folgendes umfassen: Lösungserkundung und -entwurf sowie Prototypentwicklung bis hin zur begrenzten Neuentwicklung erster Produkte und Dienstleistungen in Form einer Erprobungsserie. Vorkommerzielle Aufträge dienen als eine Vorbereitung, durch die öffentliche Auftraggeber in die Lage versetzt werden, die technologischen FuE-Risiken potenzieller alternativer Lösungen auszufiltern, bevor sie sich für eine groß angelegte kommerzielle Einführung entscheiden. Durch die Trennung von der öffentlichen Auftragsvergabe zur kommerziellen Einführung können sich vorkommerzielle Aufträge auf den Erwerb der Kenntnisse konzentrieren, die erforderlich sind, um die „besten“ Lösungen zu ermitteln, die der Markt zum Zeitpunkt der kommerziellen Einführung zu bieten hat, ohne dass dies zu einer einseitigen staatlichen Beihilfe für die Industrie führt.

- Comment Pre-commercial procurement is a preparation exercise which enables public purchasers to filter out technological R&D risks of potential alternative solutions before committing to procuring a large scale commercial roll-out. Separation from public procurement for commercial roll-out enables pre-commercial procurement to focus on acquiring the knowledge needed to identify the "best" possible solution the market can offer at the time of commercial roll-out, without leading to unilateral State aid to industry.
