- Nóta Art. 12 Lorsqu’un enfant a été déplacé ou retenu illicitement au sens de l’art. 3 et qu’une période de moins d’un an s’est écoulée à partir du déplacement ou du non-retour au moment de l’introduction de la demande devant l’autorité judiciaire ou administrative de l’Etat contractant où se trouve l’enfant, l’autorité saisie ordonne son retour immédiat.
