- Nóta There is no one term which is adequate in all contexts. Alien is historical, but carries unfortunate connotations and is somewhat obsolete : it is not used in either the Immigration Act 1971 or in the Immigration Rules. Foreign national excludes stateless persons, and may refer either to non UK nationals or non-EEA nationals. Foreigner is commonly used, but has no legal definition. In most contexts, foreign national may be the preferable term. Within the UK, a person subject to immigration and asylum legislation is a person who does not fall into other defined categories. For example, a person who is neither a British citizen nor a Commonwealth citizen with the right of abode nor a person who is entitled to enter or remain in the United Kingdom by virtue of the provisions of the 2006 EEA Regulations requires leave to enter the United Kingdom(Immigration Rules paragraph 7 ukba.homeoffice.gov.uk) Again,'where a person is not a British citizen (a) he shall not enter the United Kingdom unless given leave to do so' (Immigration Act 1971 section 3, as amended opsi.gov.uk)
