L'étranger qui tente de soustraire ou se soustrait à sa reconduite peut être condamné à une peine de prison de 3 ans maximum et éventuellement à une peine d'interdiction du territoire français IATE:3584145 .Note historique La loi du 24 juillet 2006 a créé l’ordre de quitter le territoire français (IATE:3583819) et cette mesure est devenue la mesure d’éloignement de droit commun avec la loi du 16 juin 2011. L’arrêté de reconduite à la frontière a été alors limité aux deux seuls cas énoncés ci-dessus (menace à l’ordre public et travail dissimulé). La loi du 7 mars 2016 a ensuite intégré ces deux cas au champ de l’obligation de quitter le territoire (Article L611-1 CESEDA). Depuis, la mesure d’arrêté de reconduite à la frontière n’existe plus en droit français. Depuis la loi du 16 juin 2011, la mesure d'éloignement dénommée ""arrêté de reconduite à la frontière"" (même dénomination que les arrêtés de reconduite à la frontière qui étaient auparavant très fréquemment pris contre les étrangers en situation irrégulière) ne pouvait être prise que contre un étranger non européen en situation régulière, dans deux cas très précis (voir arrêté de reconduite à la frontière IATE:3583948 – cette notion n’existe plus en droit français). La notion visée dans la présente fiche est plus large et concerne la reconduite à la frontière ""physique"", à savoir le transfert physique de l'étranger hors du territoire par les autorités de police."
