    Sainmhíniú Diese Klagen ermöglichen es dem Gerichtshof zu prüfen, ob die Mitgliedstaaten ihren gemeinschaftsrechtlichen Verpflichtungen nachgekommen sind. Die Klage kann entweder von der Kommission - praktisch der Hauptfall -oder von einem Mitgliedstaat erhoben werden. Stellt der Gerichtshof die behauptete Vertragsverletzung fest, so ist der betroffene Staat verpflichtet, sie unverzüglich abzustellen. Wenn der Gerichtshof nach einer erneuten Anrufung durch die Kommission feststellt, daß der betreffende Mitgliedstaat seinem Urteil nicht nachgekommen ist, so kann er die Zahlung eines Pauschalbetrags oder Zwangsgeldes verhängen.
