La pandémie de COVID-19, la guerre d’agression menée par la Russie contre l’Ukraine et d’autres tensions géopolitiques ont mis en évidence la nécessité de pouvoir identifier les risques pesant sur certains investissements et de mieux protéger les actifs critiques de l’UE contre ces investissements. Ces évolutions ont également contribué à l’augmentation significative du nombre d’États membres qui adoptent un mécanisme national de filtrage et à la hausse du nombre de secteurs que certains États membres soumettent au filtrage. Toutefois, une part importante des investissements directs étrangers effectués dans l’UE est toujours destinée à des États membres qui ne disposent pas d’un mécanisme de filtrage, de sorte que des vulnérabilités subsistent, étant donné que des IDE potentiellement critiques ne sont pas détectés. Le rapport d'évaluation du règlement a établi la nécessité de veiller à ce que l'ensemble des États membres disposent d'un mécanisme de filtrage permettant d'évaluer les opérations avant qu'elles ne soient réalisées.
