    Comment Elle peut avoir officiellement demandé le statut de réfugié sans toutefois avoir été reconnue comme telle par l'instance nationale compétente en matière d'asile, ou alors elle peut ne pas avoir encore déposé sa demande pour obtenir ce statut. Le terme de «demandeur d'asile» n'est pas défini au sens d'un instrument juridique international; sa définition relève de la législation nationale. Bien que l'octroi du statut de réfugié soit une prérogative de l'État, sous réserve de certaines exceptions, le statut de réfugié revêt un caractère déclaratoire plutôt que déterminant: en d'autres termes, les personnes n'obtiennent pas le statut de réfugié du fait d'une reconnaissance, mais ils sont reconnus parce qu'ils sont réfugiés.
