    Comment In order to respect the parties' right to be heard, the Commission must in its final decisions only deal with objections on which the parties were afforded the possibility to present their position. This is normally done in writing and - upon the parties' request - orally in a meeting with the Commission services where representatives of Member States are also present. The oral hearing is conducted by the hearing officer. Likewise, where the Commission rejects a complaint, or, conversely, raises objections relating to an issue in respect of which it received a complaint, it must give the complainant the opportunity to make his views known. (4) Das Kind soll über den Gegenstand, Ablauf und möglichen Ausgang des Verfahrens in einer geeigneten und seinem Alter entsprechenden Weise informiert werden, soweit nicht Nachteile für seine Entwicklung, Erziehung oder Gesundheit zu befürchten sind. Le décret n° 2009-572 relatif à l'audition de l'enfant en Justice du 20 mai 2009 précise les modalités d'application de l'article 388-1 du code civil qui rend obligatoire, dans toute procédure le concernant, l'audition du mineur qui en fait la demande et qui impose au juge de s'assurer que le mineur a été informé de son droit à être entendu et à être assisté par un avocat. Cette obligation d'information du mineur repose au premier chef sur les personnes qui s'occupent quotidiennement de l'enfant, à savoir ses parents, le tuteur, ou le cas échéant, la personne ou le service à qui il a été confié.
