    Comment Tax avoidance is technically legal but does not respect the spirit or intent of the law it purports to comply with, while 'tax optimisation' [ IATE:3571714 ] is legal and generally not seen as morally reprehensible, since it respects the spirit and purpose of tax law. Having said that, it is worth noting that the EU and some other organisations seem increasingly to consider 'tax optimisation' tantamount to 'tax avoidance', especially in the business context, and that companies themselves often also euphemistically refer to 'tax optimisation' in cases where the tax authorities might use the term 'tax avoidance'.     Comment 1. À distinguer de la fraude fiscale et de l'évasion fiscale qui sont illégales. L'évitement ou contournement fiscal implique souvent d'interpréter la législation à la lettre et d'exploiter les failles et les disparités afin de bénéficier d'un avantage fiscal qui n'était pas initialement prévu par la législation. 2. L'évasion fiscale est techniquement légale mais va à l'encontre de l'esprit et de l'objectif de la législation qu'elle est censée respecter, tandis que l'optimisation fiscale est légale et n'est généralement pas considérée comme moralement répréhensible, car elle respecte l'esprit et l'objectif de la législation fiscale. Il convient toutefois de noter que l'UE et certaines autres organisations semblent de plus en plus souvent considérer que les termes '"optimisation fiscale" et ceux d'"évasion fiscale" sont équivalents, surtout dans le contexte des entreprises, et que les entreprises elles-mêmes utilisent souvent, par euphémisme, les termes "optimisation fiscale" dans des cas où les autorités fiscales utiliseraient plutôt les termes "évasion fiscale".
