    Comment "Achtung: Auf europäischer Ebene wurde der Ausdruck als „Rückkehrentscheidung“ übersetzt und eine eigene Definition gegeben. Der Term ist nicht mit der deutschen „Ausreisepflicht“ im Sinne von § 50 AufenthG zu verwechseln, weil es sich dabei um die generelle Pflicht handelt, nach einer aufenthaltsbeendenden Maßnahme auszureisen. Im französischen Recht stellt die „obligation de quitter le territoire“ jedoch selbst eine aufenthaltsbeendende Maßnahme dar. Des Weiteren wurde die RL 2008/115/EG so umgesetzt, dass als Rückkehrentscheidungen nunmehr entweder die Ausweisung oder die Abschiebungsandrohung (schriftlicher Bescheid über die Ausreisepflicht, beinhaltet meist auch eine Ausreisefrist ( IATE:3583847 )) verwendet werden, um die Erfordernisse der Richtlinie einzuhalten. Dabei wurde auf originäre deutschen Rechtsbegriffe zurückgegriffen, sodass der Begriff „Rückkehrentscheidung“ nicht im deutschen Gesetz zu finden ist. .     Comment "Système juridique français . Attention! Le terme ""obligation"" dans l'expression ""obligation de quitter le territoire"" peut prêter à confusion et faire croire qu'il s'agit d'une obligation générale de quitter le territoire, qui peut faire suite à de nombreuses mesures d'éloignement. Or, il s'agit ici d'une mesure spécifique d'éloignement, celle qui est le plus généralement appliquée aux étrangers se trouvant en situation irrégulière, qui s'appelle ""obligation"". L'étranger est sous le coup d'une OQTF, tout comme il pourrait faire l'objet d'une interdiction de retour ou d'un arrêté d'expulsion ou d'un arrêté de reconduite à la frontière. . L'obligation de quitter le territoire français (OQTF) est la principale mesure d'éloignement des étrangers. Elle est devenue, depuis la loi du 16 juin 2011 relative à l’immigration, à l’intégration et à la nationalité, la mesure d’éloignement de droit commun, ayant vocation à s’appliquer à l’ensemble des procédures d’éloignement (sauf expulsion, interdiction judiciaire du territoire et quelques autres mesures d’éloignement). . Elle oblige l'étranger concerné à quitter la France par ses propres moyens dans un délai de 30 jours ou, dans des situations plus limitées, sans délai, dans une des situations suivantes: entrée irrégulière en France ou dans l’espace Schengen; étranger est resté illégalement en France après l’expiration de son visa, ou s’il est dispensé de visa, plus de 3 mois après son entrée en France; en cas de refus de renouvellement ou de retrait du récépissé de demande de titre de séjour ou de l'autorisation provisoire de séjour; en cas de refus de délivrance ou de renouvellement ou de retrait du titre de séjour; si l’étranger n’a pas demandé le renouvellement de son titre de séjour et est resté en France après l’expiration de son titre; si, en provenance direct d'un État Schengen, un étranger est entré ou s’est maintenu irrégulièrement en France. . L'obligation de quitter la France concerne tous les étrangers non européens. Certaines catégories sont toutefois protégées, notamment en raison de leurs attaches familiales ou personnelles en France.
